Terms and Conditions of Use
It is important that you read and understand these Terms and Conditions of Use (Ts&Cs). They are not complicated and are an expression of good sense. You will find the following topics and aspects covered by these Ts&Cs:

Firstly, who are 'we' and 'you'?
We are NDMC Limited, a company registered in England and Wales. For further details please see 'About Us'.
You are the subscriber to the Squork Maps service, either paying the monthly fee or using Squork Maps in the free 21-day trial period.
What we provide to you in exchange for a monthly rental
We provide you with a service that enables you to plot points on a map that refer to data with a geographic reference and to provide a limited amount of information about each point. You may use the Service for any legal purpose whatsoever. Uses can include those for commercial gain, for private or non-profit use.
The amount and detail of data that you may upload is determined by the level of subscription that you have chosen. Data quantity and/or data detail that exceeds the specified limit will not be saved on our server(s) and will not be plotted on a map. You may link the maps on your security-protected, personalised maps on Squork Maps to another website or web application.
We reserve the right to change any and all content, software and other items used or contained in Squork Maps and to change any of the services offered by Squork Maps at any time without notice. Any reference on Squork Maps to any products, services, processes or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, us (NDMC Ltd).
Squork Maps and the site content are provided "as is" and we disclaim any and all representations and warranties, whether express or implied, including implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. We cannot guarantee and do not promise any specific results from use of Squork Maps. We do not represent or warrant that software, content or materials on the site, the service or any platform applications are accurate, complete, reliable, current or error-free or that the site or service its servers, or any platform applications are free of viruses or other harmful components. Therefore, you should exercise caution in the use and downloading of any such content or materials and use specialised software to detect and eliminate viruses. Without limiting the foregoing, you understand and agree that you download or otherwise obtain content, material or data from or through Squork Maps at your own discretion and risk and that you will be solely responsible for your use thereof and any damages to your computer system, loss of data or other harm of any kind that may result.
What you are forbidden to do using Squork Maps
You may use Squork Maps for any legal and legitimate purpose. You MAY NOT use Squork Maps to indicate any geographic point(s) that in any way induce, aid and abet or indicate an illegal activity or place. You MAY NOT upload and display any offensive, inappropriate, obscene, unlawful or otherwise objectionable content on Squork Maps.
In the event of a reasonable complaint from a viewer or other user or upon the receipt of an inquiry or demand for withdrawal from any relevant authority (police, Data Commissioner etc), we will delete the offending data and provide the relevant authority with all known details of its origin.
You SHALL NOT knowingly upload or otherwise transmit any software viruses, malware, Trojan horses, spyware or any other malicious or destructive item of computer code (executable or not) in any form whatsoever.
The extent of our liability to you and to viewers and users of your maps
1. The effects and consequences of using Squork maps
We assume no liability, to the maximum extent of the law, for any consequences or damage that you may suffer as the result of using Squork Maps in any way. You agree to assume full responsibility for the consequences of using Squork Maps and you agree to hold harmless NDMC Limited, its officers, directors and employees for any damage or consequences suffered by you or a viewer of Squork Maps as a result of using Squork Maps.
We assume no responsibility whatsoever for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of your communications (data up- and downloads). We are not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software on account of technical problems or traffic congestion on the Internet or at any site or combination thereof, including injury or damage to your or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or up-and downloading materials in connection with the use and viewing of Squork Maps.
We assume no responsibility to the viewer or user of the personalised maps on Squork Maps for the nature and effect of the content that you upload and display on Squork Maps and its possible effects, decisions based on its use, offense and insult, accuracy and otherwise.
2. Access to and availability of Squork Maps
We will make every reasonable endeavour to ensure that you are able to use Squork Maps in accordance with its communicated purpose and functionalities. However, there may be occasions when Squork Maps is not available due to technical problems with the Internet, hosting equipment or due to routine maintenance of the site. We do not guarantee the 24/7 availability of Squork Maps. Insofar as we can control any downtime, we will minimise the period of inaccessibility as far as is reasonably possible.
In the event of non-payment of your monthly subscription, we will deny you access to both Squork Maps and your data without notice.
The limits of our responsibility for your data saved on our servers
We will take every reasonable and normally-expected precaution to keep your data intact and secure. However we are not responsible or liable in any manner for any of your data or content uploaded to Squork Maps or in connection with using Squork Maps, whether uploaded to Squork Maps or caused by other users and viewers of Squork Maps. It is for you to take all necessary precautions before granting the ability to add to or otherwise modify your data to others (viewers and contributors to your personalised maps).
Data protection aspects (UK Data Protection Act)
Insofar as we hold and/or load data onto any maps that contains any personal identifiers as defined in the Data Protection Act, will ensure that NDMC Ltd's registration with the Information Commissioner covers such details, purpose(s) and use(s). However, we are not responsible for your compliance with the Data Protection Act in respect of data uploaded to Squork Maps and its use and we strongly urge you to check on any requirements to which you may be subject. The Information commissioner's website gives help and advice (www.ico.gov.uk). As a reminder:
"As well as creating a framework for collecting and using personal data, the Data Protection Act sets standards that personal data must meet before you can use it. The standards are that personal data should be:
• adequate, relevant and not excessive;
• accurate and, where necessary, kept up to date; and
• kept for no longer than necessary.
In checking that the personal data you hold meets the information standards, you should consider:
• the number of individuals whose personal data you hold;
• the nature of the information;
• what you use it for, and how you use it;
• the way you obtained it;
• how long you hold it for; and
• the possible consequences for the individuals concerned of retaining or deleting the information.
Please take this aspect seriously, whether you are a private individual or a constituted organisation.
Complaints procedure
1. Technical and functionalities complaints
In the event of Squork Maps not functioning as represented please click here to contact us. Please allow 3 working days for us to respond to your complaint. If you receive no response from us within that period, please try us directly through the telephone number available on that page, unless you have already done so.
2. Complaints about content displayed by a user
In the event of you finding any materials, content or referenced to be wrong, offensive, illegal or otherwise likely to prejudice or affect you, please click here to contact us. If the nature of the complaint is serious, or if its removal or modification is urgent, please contact us directly through the telephone number available on that page, unless you have already done so.
Cancellation and termination arrangements
Your contract is for one month. You may cancel your contract at any time within a month by:

You may then continue to use Squork Maps until the end of the month in which you gave notice. No refunds are due or will be given due to cancellation by either party.
We reserve the right to terminate your use of Squork Maps in the event of you breaching any of these terms and conditions, particularly those that relate to illegal and/or offensive content.
